Load Finder Privacy Notice

Mack Trucks, Inc. (the “Company”, “we”, “us”, or “our”) has made arrangements for FleetRover Inc. dba Class8 (“Class8”) to provide a smart digital load board designed to help carriers streamline logistics operations (“Load Finder”). This Load Finder Privacy Notice (“LF Privacy Notice”) is intended solely to provide you with information about how the Company collects, uses, shares, and otherwise handles personal information in connection with Load Finder. Please note that Class8 operates independently from the Company, and we do not control how Class8 handles personal information. For information on Class8’s privacy policies and practices, you should review Class8’s Privacy Policy and/or contact Class8 directly.

Collection and Use of Personal Information

When you sign-up to receive information about Load Finder through our website, we collect your first and last name, email address and company name, as well as information regarding whether you are a current Company customer and your marketing preferences. This information is collected via an electronic form on our website, and it is used to email you with information that you have signed up to receive. Please note that if you consent to receive other Company communications when you sign-up to receive information about Load Finder, our handling of your information for that additional purpose is governed by our general Privacy Policy.

When you register for Load Finder, Class8 will notify us and provide confirmation of your acceptance of our Terms of Use and your consent for us to process your information as described in this LF Privacy Notice.

Class8 also provides us with ongoing access to information about your use of Load Finder through an online dashboard. This includes the following information for each load: active user ID; payload date; vehicle make and VIN; load ID; accepted miles; pick-up city and province; drop-off city and province; pick-up date; rate-per-mile; and rate. We use this information for accounting purposes and to administer and evaluate our contractual arrangements with Class8, as well as to evaluate and improve the Load Finder service. For example, we may use this data to generate reports of statistical usage data in order to understand whether certain features of the service are more popular than others.

In some circumstances we or Class8 may ask for your feedback on Load Finder, including via online surveys. We and Class8 may then share survey results with each other for the purposes of evaluating and improving Load Finder and developing and designing future services.

As with other types of personal information that we handle, we may also use your personal information for other purposes that are permitted or required by applicable law, such as for legal compliance. Please see our general Privacy Policy for further details.

For clarity, Class8 will collect additional information from and about you in connection with Load Finder. The information that you submit when registering for Load Finder, or in the course of using Load Finder (or associated services, such as customer support), is transmitted to Class8 and not to the Company. Except as described above, we do not receive or have access to this additional data that is collected by Class8.

Sharing of Your Personal Information

Information we disclose to Class8

If you own or operate one or more Mack or Volvo vehicles, and you enter a VIN for such vehicle(s) into Load Finder, we will disclose certain information to Class8 that is collected from the onboard telematics gateway in your truck(s). The data we will provide to Class8 includes VIN, vehicle speed, precise geolocation (in 5 minute increments), odometer, gross combined weight, and vehicle health and performance metrics, including fuel, oil, and other fluid levels, seatbelt status, odometer, tire and axle information, ABS braking time, hard braking event count, engine speed, engine hours, idle engine hours, top gear hours, top gear fuel, cruise hours, engine torque, and battery level (collectively, “Vehicle Data”). The Vehicle Data is not collected by us specifically for Load Finder, but rather, we collect it in connection with your use of Mack Trucks and/or Volvo Trucks connected services. However, if you authorize us to share Vehicle Data with Class8 in connection with your use of Load Finder, you should be aware that Class8 will handle it in accordance with its own policies, procedures and practices, which may differ from those of the Company. We are not responsible or liable for the acts or omissions of Class8, including any further disclosure of your information by Class8 or for their failure to protect your information.

If you do not own or operate a Mack or Volvo vehicle, we do not share any information about you with Class8.

Our service providers and affiliates

The information accessible to Mack as described above will also be available to our affiliates for the same purposes that Mack processes the data under this notice.

Other

As with other types of personal information that we handle, we may also disclose your personal information where permitted or required by applicable law. For example, without limitation, this may occur in connection with a sale of all or part of our business, to detect or prevent fraud and other unlawful activities, or to comply with our legal obligations. Other Important Notices

Your rights

You can contact us (as described below) to withdraw consent, access, update or rectify your personal information, or exercise other rights you may have under applicable privacy and data protection legislation. Such rights may be subject to certain conditions, requirements or restrictions, but we will respond to your requests in accordance with applicable law.

Your responsibilities

You are responsible for ensuring that you do not allow us to collect, use or share third party personal information in connection with your use of Load Finder, without consent from the relevant individual(s). For example, if you authorize us to share Vehicle Data with Class8, and you are not the driver of the relevant vehicle, you must ensure that you have authority to consent to our disclosure of this information. Without limiting the above, you must provide relevant notices to any third party, and obtain required consents from such individuals, before you allow us to collect, use, communicate or share such person’s information in connection with Load Finder.

Cross-border transfers

The Company and its affiliates or service providers may transfer and store your information outside Canada (and if you are in Quebec, outside Quebec). Information transferred outside Canada may be accessible to courts, law enforcement and national authorities in other countries. You may contact our Compliance Officer if you have questions about the collection, use, disclosure or storage of personal information by our affiliates and service providers outside Canada, or to obtain written information about our policies and practices with respect to such service providers and affiliates.

Duration of consent

When you consent to our collection, use, communication and disclosure of personal information for the purposes described in this LF Privacy Notice, your consent will remain valid for as long as you remain a registered user of Load Finder, unless you withdraw your consent earlier (subject to permitted exceptions under applicable laws).
